TravelCompare is a travel comparison platform that allows users to search for, compare, and book travel services offered by third-party providers, including airlines, hotels, car rental companies, and other travel-related service providers.

If you do not agree with any part of these Terms, you may not use our Service.

2. Account Registration

While you can browse our website without registering, certain features and services require you to create an account. When you register, you agree to provide accurate, current, and complete information about yourself.

3. Service Description

TravelCompare acts as an intermediary between you and travel service providers. We allow you to search for, compare, and book travel services from multiple providers in a single platform.

When you make a booking through our Service, you enter into a contract with the relevant travel service provider, not with TravelCompare. We are not a party to this contract, and we are not responsible for the delivery or quality of the travel services provided.

The information displayed on our Service, including prices, availability, and descriptions, is provided by the travel service providers. While we strive to ensure the accuracy of this information, we cannot guarantee its completeness or reliability.

4. Booking and Payment

When you make a booking through our Service, you agree to pay all fees and charges associated with that booking. You represent and warrant that you have the legal right to use any payment method(s) you provide.

Payment processing is handled by secure third-party payment processors. We do not store your full credit card details on our servers.

The prices displayed on our Service may change at any time without notice. Prices are not guaranteed until you complete your booking. Additional fees, such as taxes, service charges, and resort fees, may apply and are the responsibility of the user.

5. Cancellations and Refunds

Cancellation and refund policies are determined by the travel service providers, not by TravelCompare. These policies are displayed during the booking process.

If you need to cancel or modify a booking, you may do so through our Service, subject to the applicable cancellation policy. Refunds, when available, will be processed according to the travel service provider's policy.

TravelCompare charges a service fee for certain bookings. This fee is non-refundable, even if the underlying booking is canceled or refunded.

6. User Conduct

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Attempt to interfere with the proper functioning of the Service
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
  • Use the Service to impersonate any person or entity
  • Collect or store personal data about other users without their consent
  • Use any robot, spider, or other automated means to access the Service

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TravelCompare.

The content, organization, graphics, design, compilation, and other matters related to the Service are protected under applicable copyrights and other proprietary rights. The copying, redistribution, use, or publication by you of any such matters or any part of the Service is strictly prohibited.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TRAVELCOMPARE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TRAVELCOMPARE MAKES NO WARRANTY THAT:

  • THE SERVICE WILL MEET YOUR REQUIREMENTS
  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE
  • THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS

9. Limitation of Liability

IN NO EVENT SHALL TRAVELCOMPARE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

10. Indemnification

You agree to defend, indemnify, and hold harmless TravelCompare, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right

11. Termination

We may terminate or suspend your access to all or part of the Service, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "last updated" date at the top of this page.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. You are advised to review these Terms periodically for any changes.
